Mobile Home Space Rent Stabilization Ordinance

The City's Mobile Home Space Rent Stabilization Ordinance (Title 4, Chapter 4-39) was adopted by the San Leandro City Council, effective July 3, 2019.

Rent Review Appeal Hearing Officer's Decision: Capital Replacement Application for Mission Bay Mobile Home Park (2/3/23)

Mission Bay, LLC previously submitted a capital replacement rent increase application regarding sound wall repairs located in the Mission Bay Mobile Home Park (the “Park”) on November 15, 2021. The Rent Review Officer granted that application (5/16/22), and Barbara Sullivan, et al, timely appealed (6/15/22).  Hearing Officer Derek Chantler reached a decision regarding the appeal (2/3/23).

Hearing Officer Chantler determined that Mission Bay, LLC satisfied the requirements to impose a temporary rent increase to pay for a repair of a wall located at the Park. The rent increase will be $10.90 per month, for a maximum duration of 15 years. Pursuant to San Leandro Municipal Code (“SLMC”) section 4-39-230(g), the temporary rent increase may be imposed beginning the first full calendar month following completion of the wall repairs identified in the application. Tenants will be notified when the temporary rent increase will begin. 

Any party has fifteen (15) days to notify the City or Hearing Officer of any mathematical or clerical inaccuracies in the Hearing Officer’s decision pursuant to SLMC 4-39-227(j). Absent any identified error, the decision will go into effect on February 21, 2023. 

Rent Review Appeal Hearing Officer's Decision: Fair Return Application for Bayshore Commons Mobilehome Park (Corrected 1/11/23)

San Leandro Trailer Park, LLC previously submitted a Fair Return rent increase application regarding the Bayshore Commons Mobilehome Park (the “Park”) on February 3, 2022. The Rent Review Officer denied that application on April 19, 2022 (view this initial decision HERE), and San Leandro Trailer Park timely appealed on May 17, 2022.  On January 11, 2023, Hearing Officer Martin Eichner reached a decision regarding the appeal (see first link below).  On February 7, 2022, Hearing Officer Martin Eichner reissued his decision with minor corrections (see second link below)

Hearing Officer Eichner determined that San Leandro Trailer Park, LLC is entitled to a fair return rent increase of $18 per month. That rent increase is retroactive to June 2, 2022. The retroactive rent increase will be amortorized over a 5 year period, with interest accruing pursuant to San Leandro Municipal Code (“SLMC”) section 4-39-105(k). This results in an additional rent increase of $2.93 per month during that 5 year period. Accordingly, the rent for each mobile home space subject to the City of San Leandro’s Mobile Home Rent Stabilization Ordinance will increase by $20.93 effective February 1, 2023 to January 31, 2028,  On February 1, 2028, the fair return rent increase will remain at $18 for all affected, existing tenants
